The Evolution of Private Investigation in Ireland

Private investigation in Ireland has undergone significant transformation, particularly with the introduction of formal licensing and regulatory standards. These developments, spearheaded by the Private Security Authority (PSA), have enhanced professionalism, accountability, and public trust in the industry.

Establishment of the Private Security Authority (PSA)

The Private Security Authority (PSA) was established under the Private Security Services Act 2004 as the statutory body responsible for licensing and regulating the private security industry in Ireland. Initially, the PSA focused on sectors such as cash-in-transit, door supervision, and security guarding. Recognising the need for broader oversight, the PSA expanded its remit to include private investigators.

Introduction of Licensing for Private Investigators

On 1 November 2015, the PSA introduced mandatory licensing for private investigator contractors, marking a pivotal moment in the industry. This initiative aimed to address concerns about unethical practices and standardize the quality of investigative services. The licensing process requires private investigator contractors to adhere to the PSA 42:2015 Standard, which outlines the criteria for obtaining and maintaining a license.

Licensing Structure: Contractors and Employees

The PSA’s licensing framework distinguishes between contractors and individual private investigators:

  • Contractor License: Required for entities operating as sole traders, companies, or partnerships providing private investigator services. Contractors must obtain and annually maintain certification to the PSA 42:2015 Standard. 
  • Employee License: Introduced on 1 November 2022, this license is mandatory for individuals employed by licensed contractors to perform private investigator activities. Employee licenses are valid for three years, and applicants must undergo Garda vetting as part of the licensing process. For details, read the PSA website.

  • Enhanced Professional Standards: Licensing ensures that private investigators meet specific competency and ethical standards, fostering greater professionalism within the industry.

  • Legal Compliance: Operating without the appropriate license is an offence, with penalties including fines of up to €3,000 and/or imprisonment for up to five years.
