What is Private Investigator Licensing?


Private investigator licensing in Ireland is governed by the Private Security Authority (PSA), established under the Private Security Services Act 2004. Licensing ensures that all private investigators meet strict criteria, operate legally, and adhere to high professional standards.


Since November 1, 2015, it has been a mandatory legal requirement for all private investigators in Ireland to hold a valid license. This framework protects clients by preventing unethical practices and ensuring only qualified professionals provide investigation services.


What’s Involved in Licensing?

To become licensed, private investigators must:

  • Pass Background Checks: Ensuring they have no criminal history that could compromise their integrity.
  • Complete Certified Training: Gaining the necessary skills to conduct investigations ethically and legally.
  • Follow PSA Guidelines: Adhering to strict codes of conduct, including confidentiality, accuracy, and respect for privacy.
  • Carry Professional Insurance: Ensuring protection for both clients and investigators.
  • The PSA enforces these regulations through regular inspections and audits to maintain standards across the private investigation sector.


What Are Private Investigators Allowed to Do?

Licensed private investigators in Ireland are permitted to:

  • Conduct Surveillance: Monitoring individuals in public places to gather evidence for legal, personal, or corporate cases.
  • Access Public Records: Reviewing legal documents, company filings, and other publicly available information.
  • Perform Background Checks: Investigating the history, qualifications, or reputation of an individual or organisation.
  • Locate Missing Persons: Assisting in finding individuals for personal, legal, or business reasons.
  • Gather Evidence for Court: Collecting legally obtained data to support civil or criminal proceedings.

All activities must comply with Irish laws and professional guidelines, ensuring investigations are ethical and legal.


What Are Private Investigators Not Allowed to Do?

Private investigators must operate within strict legal and ethical boundaries. They are prohibited from:

  • Trespassing on Private Property: Investigators cannot enter private premises without permission.
  • Hacking or Accessing Private Data: Unauthorised access to emails, bank accounts, or other sensitive information is illegal.
  • Engaging in Illegal Surveillance: Placing tracking devices, intercepting communications, or using hidden cameras in private areas is strictly forbidden. 
  • Harassing or Intimidating Individuals: Their activities must not infringe on an individual’s rights or safety.
  • By following these guidelines, investigators ensure their work is compliant with the law and respects individual privacy.
